Can Foreigners Get IVF in India? An Honest Eligibility Guide

Most websites aimed at international patients answer “can I come for treatment?” with “yes, book now.” That is not the honest answer. The real answer depends on Indian law, and you deserve to know it before you book a flight, not after. This guide summarizes, in plain English, how the rules apply to international patients considering IVF in India.

The short answer

Foreign couples can access IVF and related assisted reproductive treatment in India on a medical visa, aligned with the framework of the ART (Regulation) Act 2021. That is genuinely good news for most people who write to us. Two things are equally true and worth stating up front, before anything else: surrogacy is not available to foreign nationals, and sex selection of any kind is illegal in India, for everyone, always. If a website promises either, treat it as a warning sign.

Age limits under the ART Act 2021

The Act sets statutory age windows for ART treatment: women between 21 and 50, men between 21 and 55, at the time of treatment. These are not a clinic’s house preference that a well-connected booking can bend — no centre registered under the Act may legally treat outside them. We check this first, before anything else, so you are never told no after you have already traveled.

Marital status

Married couples are the standard case the Act was written around, and most of the couples we coordinate for fall here. Single women are permitted ART in defined circumstances under the Act. What is not possible

1. Surrogacy for foreign nationals. The Surrogacy (Regulation) Act 2021 prohibits it outright. We do not facilitate surrogacy for international patients, and we will say so in the first conversation, not after a deposit.
2. Sex selection of any kind, for any reason. It is prohibited under the PCPNDT Act, for every patient, Indian or foreign, without exception. Any provider offering it is breaking Indian law, and we will not work with one.
3. Guarantees of success. Biology does not hand out guarantees, and neither do we. What you get instead is an honest, individual clinical assessment from the doctor who will actually treat you — not a marketing number.

Donor treatments

Donor-gamete treatment is regulated under the ART Act with strict conditions — registered gamete banks, mandatory screening, documented consent. Whether it applies to your specific case is a clinical and legal determination made by the treating centre, not a menu item. Visas and documents

International patients typically travel on an e-Medical visa, with an e-Medical-Attendant visa available for one accompanying family member. The treating centre issues the invitation letter that supports your visa application. Beyond that, expect to provide passports, a marriage certificate where applicable, and your prior medical records. How long you’ll need

A full IVF cycle typically needs around three to four weeks in one trip.
